This comprehensive legal framework governs all commercial interactions, reservations, digital platform usage, transaction processing, and data privacy protocols between Memories Tours and its clients, users, or purchasing parties. Memories Tours conducts its commercial operations in strict compliance with applicable international trade regulations, consumer protection standards, e-commerce directives, and financial merchant compliance frameworks established by global payment networks and acquirers.
2. Acceptance of Terms
By accessing, browsing, registering with, or utilizing the website, digital portals, or booking infrastructure operated by Memories Tours, or by submitting a booking request, making a partial or full payment, or executing a travel service contract, you (“Client,” “Customer,” or “User”) unconditionally agree to be bound by the terms, conditions, policies, and notices contained within this unified legal document.
This agreement constitutes a legally binding contract between the Client and Memories Tours. If you do not agree with, or cannot comply with, any provision set forth herein, you must immediately cease all access to the digital platforms of Memories Tours and refrain from making reservations or financial transactions through our channels. Continued access or payment submission signifies fully informed, voluntary, and irrevocable consent to these terms.
3. Definitions
In this document, unless the context otherwise requires, the following expressions shall have the respective meanings assigned to them below:
- “Agency” / “Company” refers exclusively to Memories Tours, including its authorized representatives, brand extensions, administrative officers, and operational personnel.
- “Client” / “Customer” / “You” refers to any individual, legal entity, corporate purchaser, lead guest, or representative accessing the Website, requesting services, or completing a financial transaction with Memories Tours.
- “Services” refers to all travel management solutions, bespoke itinerary planning, hotel reservations, local and international transport arrangements, guided tours, excursion facilitation, flight bookings, and associated destination management services offered by Memories Tours.
- “Third-Party Supplier” / “Supplier” refers to independent direct service providers, including but not limited to commercial airlines, charter operators, hoteliers, resort properties, local ground transport operators, cruise lines, venue managers, and activity vendors.

- “Booking” / “Reservation” means any confirmed order placed by the Client for one or more Services, which has been acknowledged and accepted by Memories Tours via written confirmation.
- “Force Majeure” refers to acts of God, unexpected natural disasters, pandemics, epidemics, governmentally imposed travel restrictions, civil unrest, war, terrorism, strikes, or major infrastructure failures beyond the control of Memories Tours.
4. Website Use Policy
The digital platforms operated by Memories Tours are provided solely to facilitate legitimate travel inquiries, verify service availability, execute lawful travel bookings, and process secure payments. Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website strictly in accordance with these terms.
Users expressly agree not to:
- Utilize the Website or its contents for any commercial, speculative, false, or fraudulent reservation.
- Access, monitor, or copy any content or information using automated mechanisms, including spiders, scrapers, or robotic crawlers, without explicit written authorization from Memories Tours.
- Inject malicious software, viruses, trojan horses, worms, logic bombs, or other technologically harmful materials into the digital infrastructure of Memories Tours.

- Attempt to gain unauthorized access to server infrastructure, database networks, or payment security portals associated with Memories Tours.
5. Eligibility
To utilize the digital booking portals, enter into contractual agreements, or execute financial transactions with Memories Tours, you must satisfy the following legal criteria:
- Legal Capacity: You must be at least eighteen (18) years of age (or the legal age of majority in your jurisdiction) and possess full legal capacity to enter into legally binding obligations.
- Authority: If you are making a reservation on behalf of a corporate entity, family unit, or travel group, you represent and warrant that you possess full legal authority to bind all members of the travel party to these Terms & Conditions.
- Accuracy of Information: You warrant that all personal data, passport details, contact information, and financial credentials provided during registration or checkout are authentic, accurate, current, and complete.
6. Booking Policy
Memories Tours acts as both a direct organizer of travel experiences and an intermediary broker for specialized Third-Party Suppliers. All bookings submitted through our digital platforms or direct travel consultants are subject to real-time confirmation based on operational capacity, inventory status, and Supplier acceptance.
A booking request initiated by a Client constitutes an offer to purchase the specified travel services. Memories Tours reserves the right, at its sole discretion, to accept or decline any booking request for any lawful reason prior to issuing an official written confirmation. The contract between Memories Tours and the Client is formally executed only upon the issuance of an official written Booking Confirmation document and receipt of required funds.
7. Reservation Process
To ensure seamless execution, reservations made with Memories Tours follow a structured processing protocol:
- Inquiry and Itinerary Selection: The Client selects or customizes a travel itinerary via our digital platforms or through a designated travel strategist.
- Data Verification: The Client provides all required traveler details, including full names matching valid travel passports, date of birth, nationality, dietary/accessibility requirements, and contact channels.
- Financial Settlement: The Client executes the full required payment through the authorized payment gateway or secure banking channels.
- Confirmation Dispatch: Upon successful settlement and verification, Memories Tours issues an official Booking Confirmation containing unique reference numbers, service vouchers, and operational breakdowns. The Client must inspect this document immediately upon receipt.
8. Payment Policy
Memories Tours maintains strict corporate financial compliance standards to support secure, modern e-commerce and point-of-sale transactions.
- Accepted Payment Methods: Payments may be processed via major international credit and debit cards (including Visa and Mastercard), verified digital wallets, direct wire transfers, or specialized payment gateways (e.g., Stripe, PayTabs, Checkout.com, Network International, Amazon Payment Services, PayPal).
- Payment Obligations: Unless explicitly agreed upon under a specific written corporate payment arrangement, full payment is due immediately at the time of booking.
- Cardholder Authorization: By submitting credit or debit card details, the Client explicitly authorizes Memories Tours and its designated merchant processing acquirers to charge the total agreed sum to the designated financial instrument.
- Currency Conversion Fees: Memories Tours is not responsible for foreign exchange fees, cross-border transaction surcharges, or currency conversion markups imposed by the Client’s card-issuing financial institution.
9. Pricing Policy
All prices published on the Website or provided within custom commercial quotations are calculated based on live supplier rates, prevailing market exchange ratios, local tax structures, and operational costs at the time of publication.
- Inclusions and Exclusions: Clear specifications regarding what is included (e.g., accommodations, guided tours, specified meals, private transport) and excluded (e.g., international flights, discretionary gratuities, personal expenditures, visa fees) are outlined on each individual booking summary.
- Price Amendments Prior to Confirmation: Memories Tours reserves the right to amend advertised pricing at any time prior to the issuance of an official Booking Confirmation.
- Errors and Omissions: In the rare event of an obvious typographical, system, or human error resulting in an incorrectly published price, Memories Tours reserves the right to correct the error and provide the Client with the choice to pay the correct price or cancel the affected reservation without penalty.
10. Currency
Transactions processed by Memories Tours are primarily billed in United States Dollars (USD), United Arab Emirates Dirhams (AED), or Euros (EUR), as displayed on the final payment screen prior to authorization.
If a Client completes a payment using a payment card backed by a non-primary card currency, the issuing bank automatically executes a conversion into the primary card currency. Memories Tours has no administrative control over bank-mandated exchange rates or foreign transaction processing fees. Consequently, refund assessments or price comparisons must take into account baseline exchange rate fluctuations.
11. Taxes & Fees
All reservations are subject to applicable federal, municipal, tourism, and statutory taxes enforced by government authorities in the destination countries.
- Included Taxes: Standard corporate taxes, value-added taxes (VAT), and mandatory service fees are included in the final presented cost prior to payment, unless explicitly stated otherwise.
- Destination Tourist Taxes: Certain jurisdictions enforce local tourist taxes, city resort fees, or environmental levies that must be collected directly from the guest on-site at the hotel property or port of entry. The Client acknowledges full responsibility for settling such localized statutory fees.
12. Booking Confirmation & Final Sale Policy
An official Booking Confirmation issued by Memories Tours serves as legal evidence of a completed reservation and validated contract.
Upon receipt of the Booking Confirmation via electronic transmission (email or secure guest portal), the Client is legally required to review all details thoroughly. Any discrepancy must be reported to Memories Tours in writing within twenty-four (24) hours of receipt.
12.1 FINAL SALE POLICY (STRICT NON-REFUNDABLE POLICY)
Once a booking request has been confirmed by Memories Tours and full or partial payment has been executed and settled, the reservation becomes FINAL AND BINDING.
Unless required by applicable law, confirmed bookings are subject to the following strict commercial conditions:
- NO CANCELLATIONS: Bookings cannot be cancelled by the Client once confirmed.
- NO REFUNDS: All paid funds are strictly non-refundable. No partial or full refunds shall be issued.
- NO MODIFICATIONS: Dates, passenger details, room types, and services cannot be modified, rescheduled, or adjusted.
- NO TRANSFERS: Reservations cannot be transferred to another individual or legal entity.
By completing the payment transaction, the Client explicitly confirms that they have carefully reviewed all reservation details and accept this Final Sale Policy without reservation.
13. Customer Responsibilities
Clients engaging the services of Memories Tours assume full personal responsibility for conducting themselves in a lawful, ethical, and safe manner throughout their travel lifecycle.
The Client agrees to:
- Comply strictly with the local laws, social norms, customs, and regulations of all visited destinations.
- Adhere to schedule directives provided by travel guides, transport captains, and group leaders.
- Maintain respectful decorum toward tour personnel, hotel staff, fellow travelers, and local populations.
- Refrain from any illegal activity, substance abuse, property damage, or disruptive behavior. Memories Tours and its direct suppliers reserve the right to terminate services to any guest exhibiting abusive, dangerous, or disruptive conduct, without liability or financial obligation.
14. Travel Documents
It is the sole and absolute responsibility of the Client to acquire, maintain, and present valid, undamaged, and legally required travel documentation prior to departure and throughout the travel period.
Required documentation includes, but is not limited to: Passports valid for the required duration, entry visas, transit visas, re-entry permits, international driver’s permits, health certificates, vaccination cards, and medical clearance documentation.
Memories Tours assumes no liability for losses, delays, travel disruptions, or financial damages resulting from a Client’s failure to secure or carry appropriate, compliant travel documentation.
15. Visa Responsibility
Unless explicitly contracted as an independent, standalone visa facilitation agreement, Memories Tours does not guarantee visa issuance and accepts no legal or financial liability regarding visa decisions made by sovereign consular authorities.
- Independent Application: The Client remains fully responsible for verifying entry requirements with foreign embassies or consulates and applying for appropriate entry clearances in a timely manner.
- Consular Rejections: The refusal, delay, or denial of a visa by immigration authorities does not modify, suspend, or invalidate the standard terms of the Final Sale Policy outlined herein. Non-issuance of a visa does not entitle the Client to monetary refunds from Memories Tours, unless required by applicable law.
16. Passport Requirements
All passports held by international travelers booking through Memories Tours must meet standard global border control criteria:
- Validity Duration: Passports must remain valid for a minimum of six (6) months beyond the scheduled end date of the travel itinerary.
- Blank Visa Pages: Passports must contain a sufficient number of blank, unassigned visa pages to accommodate entry and exit stamps, customs endorsements, and visas.
- Condition: Passports must be free of significant physical damage or unauthorized markings that could lead to border entry refusal.
17. Health Requirements
The Client acknowledges that foreign travel may involve exposure to health risks, physical exertion, unique environmental factors, and varying regional medical standards.
The Client is responsible for evaluating their physical condition, consulting certified medical professionals, and securing all mandatory or recommended inoculations prior to departure. The Client must inform Memories Tours prior to booking of any pre-existing medical conditions or physical mobility limitations that may require specialized logistical arrangements.
18. Insurance Recommendation
MANDATORY NOTICE REGARDING TRAVEL INSURANCE
Memories Tours STRONGLY RECOMMENDS that all Clients purchase comprehensive international travel insurance coverage from an accredited insurance underwriter simultaneously with booking.
Such coverage should include trip cancellation/interruption protection, emergency medical coverage, air medical evacuation, baggage loss/damage, and delays due to Force Majeure events.
19. Hotel Terms
Hotel, resort, and accommodation bookings facilitated by Memories Tours are governed by both this agreement and the specific property rules of the accommodation provider:
- Check-in / Check-out Times: Standard check-in ranges between 14:00 and 15:00, while check-out ranges between 10:00 and 12:00 local time. Early check-in or late check-out requests are subject to availability and cannot be guaranteed unless reserved in advance.
- Incidental Charges: Hotels require a valid credit card pre-authorization or cash deposit upon check-in to cover incidental expenses (minibar, spa, room service). These are settled directly between the Client and the property.
20. Tours & Activities
Guided tours, excursions, adventure activities, venue entries, and specialized events arranged by Memories Tours are managed with an emphasis on guest experience and security.
Memories Tours and its local ground operators reserve the right to alter itinerary sequences, substitute comparable sight-seeing points, or modify activity durations without notice if operational safety, road conditions, localized closures, or weather conditions dictate such adjustments.
21. Transportation
Ground transportation services, including private luxury transfers, chauffeured sedans, group coaches, and intercity train services, are managed to maintain high standards of safety and comfort.
Luggage limitations are strictly bound by vehicle passenger capacity and localized safety laws. Chauffeured transfers include standardized complimentary wait times (typically 60 minutes for airport arrivals and 15 minutes for hotel pick-ups).
22. Flight Disclaimer
Where Memories Tours integrates commercial flight arrangements into a travel package, the Client acknowledges that air transportation is provided by independent commercial airline carriers.
Flight schedules, operational routes, aircraft types, and seating arrangements are maintained under the exclusive control of the operating carrier. Memories Tours accepts no legal liability for flight delays, cancellations, schedule adjustments, missed connections, or lost baggage handled by air carriers.
23. Third Party Suppliers
Memories Tours functions as an independent travel organization and intermediary agent connecting Clients with elite Third-Party Suppliers, including airlines, cruise lines, hoteliers, transport providers, and activity vendors.
Third-Party Suppliers operate as independent legal entities and are not employees or direct partners of Memories Tours. Memories Tours is not liable for acts, omissions, defaults, breaches, personal injuries, property damage, or delays caused by any Third-Party Supplier, unless required by applicable law.
24. Special Requests
Memories Tours strives to accommodate personalized travel requests, including specific dietary arrangements, room locations, preferred bed configurations, or physical accessibility support.
Special requests must be submitted in writing during booking. While communicated to relevant partners, special requests cannot be unconditionally guaranteed unless explicitly confirmed in writing on the Booking Confirmation.
25. Children Policy
Travel bookings involving minor children (under 18 years of age) are subject to specific operational parameters: valid proof of age may be requested, and minors traveling with single parents or non-parental guardians must carry notarized parental consent documentation as mandated by destination immigration authorities.
26. Force Majeure
Memories Tours shall not be held legally liable, financially responsible, or considered in breach of contract for any delay, failure in performance, modification of services, or cancellation of reservations resulting directly or indirectly from a Force Majeure Event (including natural disasters, pandemics, war, civil unrest, border closures, strikes, or utility failures).
Under Force Majeure conditions, Memories Tours shall endeavor to secure supplier credit vouchers or alternative dates, but is under no obligation to process monetary refunds where underlying funds have been committed to non-recoverable third-party travel infrastructure, unless required by applicable law.
27. Limitation of Liability
To the maximum extent permitted by applicable commercial law:
- Exclusion of Consequential Damages: Memories Tours shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, enjoyment, or business interruption.
- Cap on Direct Liability: In any event where Memories Tours is determined to be legally liable for direct damages, the total aggregate liability shall be strictly capped at the total monetary value paid by the Client to Memories Tours for the specific booking giving rise to the claim.
28. Indemnification
The Client agrees to defend, indemnify, release, and hold harmless Memories Tours, its officers, directors, employees, and agents from and against any legal claims, liabilities, damages, losses, or legal expenses arising out of the Client’s breach of these terms, violation of local laws, physical property damage, or initiation of unauthorized chargeback claims.
29. Disclaimer
The digital platforms, website content, promotional materials, pricing schedules, and itinerary descriptions provided by Memories Tours are offered on an “as is” and “as available” basis without warranties of any kind, whether express or implied. Memories Tours disclaims all implied warranties of merchantability or fitness for a particular travel purpose.
30. Intellectual Property
All software, platform design, text, destination guides, photos, videos, logos, and trademarks published on the digital platforms of Memories Tours are the exclusive intellectual property of Memories Tours and protected under international copyright treaties. Content may not be copied, reproduced, or exploited without prior written authorization.
31. Website Security
Memories Tours deploys SSL and TLS cryptographic protocols to ensure all communications and data inputs across digital portals are encrypted. While enterprise security measures are maintained, Users acknowledge that no internet data transmission can be guaranteed completely immune to unauthorized security breaches.
32. Fraud Prevention
Memories Tours enforces real-time automated fraud scoring and risk checks. The Company retains full authority to request secondary verification documents (e.g., passport copy or proof of payment ownership) and reserves the right to cancel any reservation suspected of fraudulent origin or unauthorized card usage.
33. Chargeback Policy
Memories Tours adheres strictly to global credit card network standards (Visa, Mastercard, Stripe, PayTabs, Checkout.com, Network International, Amazon Payment Services, PayPal):
- Pre-Dispute Contact: The Client explicitly agrees to contact Memories Tours directly in writing prior to initiating any chargeback request or payment reversal with their bank.
- Resolution Period: The Client agrees to allow Memories Tours fourteen (14) business days to investigate and resolve any service query.
- Prohibition of Unjustified Chargebacks: Initiating a dispute for services delivered as contracted or confirmed bookings governed by the Final Sale Policy is considered an abusive chargeback. Memories Tours will submit full booking evidence, IP logs, and contracts to defend against fraudulent disputes and recover associated legal costs.
34. Payment Security
All credit card processing interfaces integrated into our platforms adhere strictly to the Payment Card Industry Data Security Standard (PCI DSS). Memories Tours does not store or process sensitive credit card PANs or CVV numbers on internal servers; transactions are tokenized via PCI-DSS Level 1 certified gateways.
35. Privacy Policy

39. Data Protection

40. Marketing Communications
Direct marketing emails are transmitted on an opt-in basis. Clients maintain the absolute right to unsubscribe at any time using the link in promotional footers. Opting out does not affect essential operational transaction updates.
41. Customer Rights
Under applicable regulations (including GDPR), Clients maintain rights to: Access, Rectification, Erasure (“Right to be Forgotten”), Restriction of Processing, Data Portability, and Objection to processing for marketing purposes.
42. Governing Law
This agreement, platform usage, and all travel bookings shall be governed by and construed exclusively in accordance with the substantive laws of the designated commercial operating jurisdiction of Memories Tours, without regard to conflict of law principles.
43. Dispute Resolution
Disputes shall be addressed first through 30 days of informal amicable negotiations. If unresolved, disputes may proceed to formal confidential mediation, or ultimately to the exclusive jurisdiction of the competent courts in the designated operating jurisdiction of Memories Tours.
44. Severability
If any provision of this agreement is held invalid or unenforceable by a competent court, such provision shall be severed, and the remaining terms shall continue in full force and effect.
45. Entire Agreement
This document constitutes the complete and exclusive agreement between the Client and Memories Tours, superseding all prior oral or written discussions, promises, or promotional materials.
46. Changes to Terms
Memories Tours reserves the right to revise these terms at any time. Updates become effective immediately upon publication. Continued use of our booking services signifies acceptance of updated terms.
47. Contact Section
For legal inquiries, customer support, or privacy requests, Clients may contact Memories Tours through the official contact submission portal located on the primary domain of Memories Tours.
48. Customer Acceptance
By executing a transaction or selecting “I Accept the Terms & Conditions,” the Client confirms having read, understood, and agreed to all terms herein, specifically acknowledging the Final Sale Policy (Section 12.1) and Chargeback Policy (Section 33).
